Conditions of Sale 

These Conditions of Sale apply to any sales of products or services that you may order from Stark Jewelers ("we", "us", and "our"), using:

  1. the website www.starkjewelers.com and any associated mobile or digital applications that refer to these Conditions of Sale (the “Platforms”),

  2. by contacting our at our store through phone calls, or emails to admin@starkjewelers.com

(the Platforms is referred to as the “Sales Channels”).

Stark Jewelers, has its registered office at 2372 Fair Oaks Blvd, Sacramento, CA 95825 and is an affiliate of Stark Jewelers, which owns and edits the Platforms pursuant to the Terms of Use. If placing an order by the Platforms, you agree to be bound by the Terms of Use, which are incorporated into these Conditions of Sale. In addition, our information collection practices and the ways in which we may use and protect that information, are further set out in our Privacy Policy. By using the Sales Channels and placing orders in store, you agree to be bound by our Privacy Policy, which is incorporated into these Conditions of Sale by reference.

Please read these Conditions of Sale carefully. These Conditions of Sale are applicable to any order placed through the Sales Channels, and include an agreement to arbitrate any disputes on an individual basis. Please note that before placing an order for products or services, you will be asked to agree to these Conditions of Sale. If you do not agree to these Conditions of Sale, then you will not be able to order any products or services through the Sales Channels.

Updates to These Conditions of Sale


We may make changes from time to time to these Conditions of Sale so please check back regularly to keep informed of updates. The latest version of these Conditions of Sale will always be available on the Platforms or on request. Any new version of these Conditions of Sale shall take effect immediately upon the date of posting and will govern any orders of products or services made as of that date. Any changes to the Conditions of Sale made after you have placed an order will not affect that order and your relationship with us, except as may be required by applicable law.

Purchasing Eligibility


Only individuals (and not legal entities) who (a) have reached the age of legal majority required to enter into contracts (eighteen in most states); (b) have legal capacity to enter into contracts; and (c) where shipping is applicable, have a shipping address in the continental United States of America, Alaska, Hawaii or the District of Columbia, may order products through the Sales Channels. If you are under the age of legal majority or otherwise cannot lawfully enter into a contract, you must have your parent or guardian place an order on your behalf and they will be asked to agree to these Conditions of Sale.

By placing an order through the Sales Channels, you represent and warrant that you are a bona fide end-user customer purchasing for your own or another’s personal use and will not deliver, sell or otherwise distribute our products or purchase our products or services for commercial purposes. Bulk purchases and purchases for resale are prohibited.

Product Availability and Quantity


All orders placed through the Sales Channels are subject to product availability and acceptance of such orders by us. Your purchase is not complete until you receive confirmation from us by email or otherwise. The Client Relations Center can provide more information as regards these products or the availability of other products. For information about the order process, please refer to our Order Process section below.

Quantity limits may apply in relation to orders for certain products.

We reserve the right to refuse at any moment in time, without prior notice, orders exceeding a certain number of authorized products.

Guest Checkout


To place an order through the Platforms, you may place an order as a guest without creating an online account. Where you place an order as a guest, we may still create an account on our internal systems to record your purchase(s).


Personalized Services


Personalization (for example engraving) or other services may be available on a selection of products. If you wish to have your product personalized, please provide the details as requested on the product page.

We reserve the right to withhold or refuse acceptance of any order for personalized products, or with a message card, that contains language that is objectionable, unlawful or contrary to our policies. You are responsible for ensuring that any wording you provide for personalizing products is correct.

In addition, orders for personalized products cannot be cancelled and such products that have been personalized in any way or otherwise made to your bespoke specifications cannot be returned to us for exchange or refund (except where defective), and are considered final upon receipt of a written Acknowledgement of Order, as described in these Conditions of Sale.

Order Process


For orders placed through the store, our staff will assist you in placing your order and will verbally ask you to confirm the details of your order.

For orders placed through the Platforms, desired products should be placed in the shopping bag (subject to availability and quantity limits) and you should proceed to “checkout” when ready to purchase. During the checkout process, you should review your shopping bag to confirm all details prior to completing your purchase. Except for personalized products (as further detailed above), product is not guaranteed as available for purchase until the order is placed and you receive a written Confirmation of Order & Shipment.

We reserve the right, in our sole discretion, to refuse, cancel and terminate orders at any time on reasonable grounds. For example, we may refuse, terminate or cancel your order if there is an ongoing dispute concerning payment of a prior order or if we suspect, in our sole discretion, that you have engaged in (i) fraudulent activities; (ii) the import of product activities which we have not intended; or (iii) have otherwise violated these Conditions of Sale.

Prices, Taxes and Shipping Costs


All prices shown or quoted on the Platforms are in U.S. Dollars unless otherwise stated and exclude sales tax, shipping costs and other taxes unless otherwise stated. Sales, use or other taxes will vary based on the location to which products are being delivered. You should check updated prices and currency carefully.

Shipping and handling costs, if any, are described in the Shipping Policy below or by our staff. Shipping and handling costs will only be added to the product price after you have chosen your delivery options, and will be summarised before you are asked to confirm and place your order.

We reserve the right to modify prices and delivery costs at any time without prior notice. The price of a product and delivery costs displayed on the Platforms or quoted by Squarespace, as indicated at the time we provide you with a Confirmation of Order, will be honored by us.

We take reasonable care that the prices of products and delivery costs are correct when the relevant information is communicated to you via the Sales Channels. However, it is possible that, despite our reasonable efforts, some of the products offered or shipping and handling costs may be incorrectly priced and/or applicable laws have changed that may impact taxes associated with your order. If any of the products or any delivery costs are incorrectly priced and/or a different tax applies, we will contact you as soon as possible to reconfirm the order and new amounts. If we are unable to contact you using the contact details you have provided during the order process, we will cancel the order and notify you in writing. If we mistakenly accept and process your order where a pricing or delivery cost error occurs, we may cancel the order and refund you any sums you have paid.

Please note that changes to applicable law between the date your order is placed and the date you are sent a written Confirmation of Order & Shipment may result in changes to the taxes associated with your order. If the resulting change is an increase in the taxes that you are charged, we will contact you and ask that you reconfirm your order.

Payment


We accept the payment methods identified in the order process via the Sales Channels. When ordering, you will need to provide your payment details through the appropriate Sales Channels. Depending on the means of payment, we may require additional information, including specific forms of identification. All payment card holders are subject to validation check and authorization by the card issuer. If your payment card issuer refuses to authorize payment to us, you will need to contact your card issuer directly to solve this problem.

Other payment methods may also be subject to validation checks and authorization by the payment system providers. You expressly authorize us to perform security checks, where we deem necessary, to transmit or to obtain information (including any updated information) about you to or from third parties, including but not limited to your payment card details, to authenticate your identity, validate your payment card, obtain an initial payment card authorization, and authorize individual purchase transactions.

Depending on your payment method, type, and nature of your purchase, your account may be immediately debited during the checkout process or a hold may be placed on your account for a period of time or until the product is shipped. Please contact our staff or your payment card provider for more details.

Where we offer a financing option and you choose to use it to pay for your order, the payment and finance option will be subject to both these Conditions of Sale and the applicable terms and conditions of our finance provider, who is disclosed before or during the checkout process. You will have the opportunity to acknowledge and agree to the finance provider’s terms and conditions before confirming the finance option as your method of payment. Note that any selected product(s) and/or service(s) will be held for a limited period of time to permit you to complete the financing process and will be released if you fail to complete the purchase within the time limits.

Where we offer you the ability to prepay for your products, either in full or as a partial prepayment, the prepayment will be taken immediately following the placement of your order and subject to the specific requirements communicated by the applicable Sales Channels during the prepayment process. Prepayments (in whole or in part) are non-refundable; however, prepayments shall not impact your legal rights under these Conditions of Sale.

When using the Sales Channels, we accept credit cards and bank wire transfer for orders placed by telephone through the Client Relations Center, and such orders are subject to an order approval process. We do not charge a fee for bank wire transfers; however, some financial institutions may charge a fee for using a bank wire transfer. Your order will not be processed until the payment has been received and confirmed by us, and will be cancelled if the wire transfer payment is not credited into our bank account within [seven (7) days] after the order is placed.


Acknowledgement of Order


Once your order has been placed through the Sales Channels, you will receive a written Acknowledgement of Order (by e-mail or otherwise confirming the details of your order together with an order reference number). Please make sure that you save this order reference number for any future enquiries regarding your order. Except for personalized products as outlined above, this Acknowledgement of Order is not an acceptance of your order. To confirm the order, we will conduct our usual credit, anti-fraud, security and related legal checks and, if acceptable, will then process your order. Upon receipt of the Acknowledgement of Order, it is your responsibility to review it and confirm that it accurately reflects your intended order. If you have any questions or concerns or if the Acknowledgement of Order does not reflect your intentions, you should contact the Client Relations Center or Remote Boutique promptly.


Confirmation of Order & Shipment


Upon shipment of your order, we will send you a Confirmation of Order & Shipment in writing (by e-mail or otherwise). This Confirmation of Order & Shipment constitutes our acceptance of your order and indicates the existence of a binding sales contract, except for personalized products, where our Acknowledgement of Order constitutes our acceptance of your order and indicates the existence of a binding sales contract. No agreement for purchase is complete until we send you a Confirmation of Order & Shipment.


Shipping Policy



We only accept orders for shipping within the continental United States of America, Alaska, or Hawaii.  Kindly note that Stark Jewelers does not deliver to P.O. Boxes, APO/FPO addresses, hotels, hospitals, freight forwarders or directly to UPS and FEDEX store locations. For further information, please contact us.

Store pick-up is offered free of charge. We will inform you by e-mail or by telephone when the product is ready for pick-up at the store.

If you order several products, we reserve the right to ship the order only once all products are available (there will be no partial shipments, unless otherwise communicated to you).


Delivery


We will use reasonable efforts to ensure delivery by the carrier within the estimated delivery time from the date of our written Confirmation of Order & Shipment except if your purchase relates to a product or service that we have explained to you will take additional time to deliver, for example in the case of products or services that we personalize or produce to your specifications.

In certain instances, you may be able to choose a specific delivery date if available on the Sales Channels. If this option is provided to you, any such delivery date remains subject to our confirmation.

If delivery of products is delayed, we will inform you as soon as possible and will use reasonable efforts to minimize the delay. With the exception of personalized products, if we do not deliver within thirty (30) days from the date of the written Confirmation of Order & Shipment or any other delivery time as indicated by us, you may contact us to cancel the relevant order and we will refund of any sums you pre-paid for products not delivered.

In any event, your sole remedy for any failure by us to deliver the order to you shall be your right to cancel the relevant order and receive a refund of sums you pre-paid us for any products which you have not received.

When estimating your delivery time, please allow time for credit approval, address verification, security checks and order processing. Please note that delivery is always subject to receiving your full payment.

If you wish to have your order delivered in less than 2 Business Days* or on a weekend, please check feasibility with our staff. If feasible, you may incur additional fees, which will be communicated to you before your order is placed.

 *All order delivery date estimations are subject to stock availability and may be delayed for special requests (e.g., sizing adjustment or engraving).

**Saturday and U.S. federal holidays will not be considered as a regular business day with respect to estimated delivery lead time. Delivery on Saturday may however be proposed as a service to specific zip codes by the Client Relations Center. Please contact the Client Relations Center for more specific information.

We will require a signature by you or an adult (+21) at the delivery address (unless arranged by you otherwise), to confirm the delivery of each product, at which point risk and responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example, as a gift), then you understand and accept that evidence of a signature by such recipient (or at that delivery address) is evidence of delivery and fulfilment of the sales contract and transfer of responsibility to the recipient in the same way as if the product had been delivered to you. We reserve the right to deliver products only to the person who is the intended recipient of the order as stated on the label of the parcel and to request ID check for verification purposes at the time of delivery for certain categories of products.


Invoices

When ordering products via the Sales Channels, you will receive an invoice that will be sent to you in writing (to your e-mail address as a PDF attachment or otherwise).


Returns and Exchanges

Stark Jewelers allows you or the Gift Recipient (as defined below) to return Stark Jewelers’ products purchased through the Sales Channels within thirty (30) days following delivery for an exchange, or an equivalent amount of store credits, but subject to the further terms and conditions set forth below.

(a) Return Process

In accordance with these Conditions of Sale, products that have been purchased through the Sales Channels may be returned for an exchange, or store credits with equivalent amount. Please follow the steps mentioned below:

Return to our store: 

Call us to request a return label to ship the Stark Jeweler’s product to our store. 

Kindly prepare the creations in the original presentation box and ensure they are in perfect condition with all their packaging and accessories. The box must be safely sealed.

You may also bring your order directly back to our store with the proof of purchase in your email inbox. Our staff will be delighted to assist you.

Exchange your order:

Kindly prepare the creations in the original presentation box and ensure they are in perfect condition with all their packaging and accessories. The box must be safely sealed. 

Please contact our Client Relations Center at +1 (916) 646-4374 to finalize your exchange request. 

Please note that you must keep a proof of return shipment and we accept no liability in the event that such proof cannot be produced. Only merchandise received by Stark Jewelers will be eligible for exchange. 

 

(b)   Condition of Returned Products

We will verify that the returned product satisfies these Conditions of Sale and, if so, then proceed with the applicable store credits or exchange.

Only products in a new and unused state, in perfect condition, with all protective materials in place and tags and stickers attached to them (if applicable), as well as with the original Stark Jewelers box and delivery package, including all accessories and documents are eligible for return. We reserve our right not to accept any return if the product shows signs of wear or has been used or altered from its original condition in any way or, as an alternative, may reduce the amount of any applicable store credits or exchange accordingly. If you have received free items as part of your order, they must be returned with the products.

All returns will be subject to strict Quality Control (“QC”) by us to ensure that the returned products satisfy these requirements. If the products do not meet QC standards, we will refuse the return, and the products will be returned to you.

Failure to comply with these Conditions of Sale will entitle us to refuse the returned product and send it back to you, at your own cost.

(c) Products You Cannot Return or Exchange

Orders for products that have been personalized or otherwise made for you with special designed specifications cannot be cancelled and such products cannot be returned for exchange or store credits. This includes, without limitation, custom orders, special orders, and products that have been engraved or altered from its original condition (resized, modified).

(d)   Refunds

All sales are not refundable, but can subject to exchange, or store credits if purchased through the Sales Channels, or in the store, provided that the return complies with these Conditions of Sale. Only the buyer will be entitled to receive a refund of the purchase price. In no event will a person who has received the product as a gift (i.e. a “Gift Recipient”) be entitled to receive a refund. If you are a Gift Recipient and wish to return a product, please contact the Client Relations Center to discuss your options.

If the return complies with these Conditions of Sale, we will use commercially reasonable endeavours to provide the store credits equivalent to the purchase price to the buyer with a Stark Jewelers gift card issued by Stark Jewelers.

(e)   Exchanges

You may return a product purchased through the Sales Channels for exchange with another Stark Jewelers product, provided that the return complies with these Conditions of Sale. The sale of the returned product will be cancelled and a new order for the product ordered must be placed. Should a product be returned to Stark Jewelers for exchange with a less expensive product, only the buyer of the returned product will be entitled to receive a refund of the price difference. If a product is returned for exchange with a more expensive product, you will have to pay the price difference.


Manufacturer’s Guarantee and Your Legal Consumer Rights


We are committed to ensuring that each product strictly complies with our quality criteria and that it has passed all our controls, both technical and aesthetic.

Selected products are covered by Stark Jewelers.

In your capacity as consumer, you may have legal rights under the applicable law of governing the sale of consumer goods; those legal rights are not affected by these Conditions of Sale or the applicable Stark Jewelers Guarantee.


Complimentary Services

 

The following complimentary services will be proposed, free of charge, by the Sales Channels:

(a)  Gift Wrap and Packaging

All orders will be shipped with the Stark Jewelers box gift wrapped in special packaging. We currently do not provide gift wraps, nor gift notes.

(b)  Engravings

Engraving may be available on specific products. Please contact our staff to see if engraving is available for the product. Orders for personalized products are final, and cannot be cancelled or returned for exchange.


Repairs


For any repair inquiries relating to a product ordered through the Sales Channels, please contact our staff.


Product Descriptions


We try to ensure that the product information, including descriptions, dimensions, and colors, provided is accurate and complete. However, we make no guarantees, whether express or implied, in relation to the accuracy, reliability and completeness of such information. In particular and where applicable, any description and information concerning the weight of precious materials and the number of stones and carats are provided as an indication only and may vary slightly.


Limitation of Liability


To the fullest extent permitted by applicable law, we disclaim and exclude all other terms, conditions and warranties in relation to the products and Sales Channels whether express or implied by statute or otherwise or arising from any previous course of dealing or usage or trade practice.

Nothing in these Conditions of Sale limits or excludes our liability for any liability which cannot be limited or excluded by applicable law.  Subject to the preceding sentence, our aggregate liability to you under these Conditions of Sale for any order whether in contract, tort (including negligence) or otherwise, even if we have been advised of the possibility of such damages, shall in no event exceed the one hundred percent (100%) of the price paid for the product(s) in your order.

Please note that in some jurisdictions, including the State of New Jersey, USA, consumer protection laws do not allow certain exclusions or limitation of warranties or liabilities, and consequently some of the above exclusions and limitations do not apply.


General Provisions


If any provision, or part of a provision, of these Conditions of Sale is deemed to be illegal, invalid or unenforceable, the remainder of the provisions of these Conditions of Sale shall be unaffected and shall continue to be fully valid, binding and enforceable.

These Conditions of Sale (and associated terms incorporated by reference) constitute the entire agreement between you and us in relation to the order of products or services, and replace and extinguish all prior agreements, draft agreements, arrangements, undertakings, or collateral contracts of any nature made by the parties, whether oral or written, in relation to such subject matter.

We are not responsible for any failure or delay in performing or complying with our obligations under these Conditions of Sale which arises from any cause beyond our reasonable control.

The waiver by us of a breach of any provision of these Conditions of Sale will not operate to be interpreted as a waiver of any other or subsequent breach.

This contract is between us and you. No other person shall have any rights to enforce any of its terms. However, if you purchase a product as a gift, the recipient of your gift will have the benefit of the applicable Guarantee.


Governing Law; Agreement to Arbitration of Claims


Arbitration Required, Except for Small Claims.  Any dispute, controversy or claim arising out of or related to the Conditions of Sale, including the validity, invalidity, breach or termination of the Conditions of Sale, or to any product purchased from Stark Jewelers through the Sales Channels, and any communications to or between us (a “Dispute”), will be resolved by binding arbitration, rather than in court, except that a consumer or Stark Jewelers may assert claims in small claims court if such claims qualify.

Informal Dispute Resolution.  Before bringing any dispute in arbitration, you and Stark Jewelers agree that you will first notify the other party and make reasonable efforts for a period of thirty (30) days to resolve amicably any Dispute. This requirement is a pre-condition, and no claim shall be filed in arbitration (or small claims court) until this provision is first met.

Jury Trial and Class Action Waiver.  You understand and agree that you are waiving your right to sue or go to court to defend your rights, including to a trial by jury, under these Conditions of Sale. IN ADDITION, YOU AND STARK JEWELERS UNDERSTAND AND AGREE THAT THE PARTIES WILL PURSUE ANY DISPUTE ON AN INDIVIDUAL BASIS.  THE ARBITRATOR IS EMPOWERED TO RESOLVE THE DISPUTE WITH THE SAME REMEDIES AVAILABLE IN COURT, INCLUDING PUBLIC INJUNCTIVE RELIEF IF YOU ARE LOCATED IN CALIFORNIA..  YOU AND STARK JEWELERS AGREE THAT EACH MAY NOT BRING A CLAIM AGAINST THE OTHER AS PART OF ANY CLASS ACTION, CLASS ARBITRATION, OR OTHER REPRESENTATIVE PROCEEDING.

How Arbitration Works. In order to file a complaint for arbitration after you and we have failed to resolve our Dispute through the informal process described above, you can go to the American Arbitration Association’s website at https://www.adr.org/Support or call 1-800-778-7879. You or we must include documents sufficient to demonstrate that we followed the information resolution process with the filing of any arbitration complaint. At your election, the arbitration will be conducted through video conference, on the papers, or in the state and county where you reside (as determined by your address on file with Stark Jewelers) or as otherwise agreed between the parties by the American Arbitration Association (“AAA”) under its rules, including the AAA's Supplementary Procedures for Consumer-Related Disputes, also available from AAA.    Payment of all filing, administration and arbitrator fees will be governed by the AAA's rules. These Conditions of Sale shall be governed by and construed in accordance with the Federal Arbitration Act and, where applicable, the laws of the State of California, without reference to conflict of laws provisions.

The Service Entity, Stark Jewelers, which owns and edits the Platforms pursuant to the Terms of Use, and is responsible for our information collection practices and the ways in which we may use and protect that information pursuant to the terms of the Privacy Policy and the Cookie Policy.

“Service Entity” means for services with delivery to the Country:

  • For services to clients based in the United States: Stark Jewelers, a company incorporated under the laws of the State of California, with a principal place of business at 2372 Fair Oaks Blvd, CA 95825, USA

 

“Country” means United States of America.

We may make changes from time to time to these Conditions of Service so please check regularly to keep informed of updates. The latest version of these Conditions of Service will always be available on the Platforms. Any new version of these Conditions of Service shall take effect immediately upon the date of posting and will govern any orders of Services made as from that date. Any changes to the Conditions of Service made after you have placed a Service Order will not affect that order and your relationship with us, except as may be required by applicable law.

ABOUT STARK JEWELERS AND THESE CONDITIONS OF SERVICE. These Conditions of Service apply to any after sale services (the “Services”, and each such order a “Service Order”) that you may order from the Service Entity (as defined above) and/or that at any time of the repair process will imply:

-        Using the Stark Jewelers website and any associated mobile or digital applications that refer to these Conditions of Service (together, the “Platform”);

-       By e-mail; or

-        By telephone via our Stark Jewelers (i) staff or (ii) Store (the “Client Relations Center”).

These Conditions of Service will prevail any other term and condition you may receive from Stark Jewelers. The service entity, that will provide the Services to you, will depend on your delivery address where we will return the products (the “Service Entity”, “Stark Jewelers”, "we", "us" and "our"):

Please refer to the bottom of these Conditions of Service for terms and conditions applicable to your specific location.

The Services/ Service Order include, among other things, the online ordering of repair services, the online approval of any cost estimates, the online tracking and the online payment (as made available to you on the Platforms, e-mail and/or Client Relations Center) for the order of a repair service that you may have made via our Platforms, e-mail or the Client Relations Center (together the “Service Channels”).

Please read these Conditions of Service carefully, as they will apply to any Services or Service Order placed as above. Depending on your location, these Conditions of Service may also include an agreement to arbitrate any disputes on an individual basis. Service Orders placed with third parties (such as authorised retailers) and complete brick and mortar Services are in principle not subject to these Conditions of Service. Please note that before placing an order for the Services, you will be asked to accept these Conditions of Service. If you do not accept the terms set forth in these Conditions of Service, you will not be able to order any Services through the Service Channels.

Eligibility

We accept Service Orders placed only by individuals (and not legal entities) who (a) have reached the age of legal majority required to enter into contracts; (b) have legal capacity to enter into contracts; and (c) have a shipping address in the Country. If you are under the age of legal majority or otherwise cannot lawfully enter into a contract, you must have your parent or guardian place a Service Order on your behalf and they will be asked to agree to these Conditions of Service.

By placing a Service Order, you represent and warrant that you are a bona fide end-user customer acting for your own or another’s personal use and will not use, deliver, sell or otherwise market or purchase the Services for commercial purposes. If despite our efforts, the Service is no longer available or we believe, for legitimate reasons, that a Service Order would violate these Conditions of Service, we may refuse such order.

Important: Stark Jewelers is free to decide what products are eligible for Services as provided herein.

Request for service

If you wish to order Services via the Service Channels, please contact us directly through phone calls, or emails to schedule an appointment.

The provided information shall be true, accurate and not misleading, as it will be used as a reference for the Services.

 

Shipping your product

You must strictly follow the instructions of Stark Jewelers as described herein or as provided via the Service Channels, as the case may be. Important to note that not all products can be shipped; please read carefully the Conditions of Service herein and/or the instructions on the Service Channel you use.

If Stark Jewelers does not provide you with a Service Kit:

Please adequately package your product with all due care and taking into consideration the value thereof. Any damage, destruction or loss due to inadequate packaging will be your sole responsibility.

If Stark Jewelers provides you with courtesy shipping:

Once your packaging is ready, please follow the instructions provided by us. If Stark Jewelers provides you with courtesy shipping, the shipping will be free of charge. However, note that you are required to send us your product only through our transport partner in accordance with the terms herein. Stark Jewelers declines any and all responsibility for any damage, destruction, loss or theft of your product if it is not sent via our authorized transport partner in strict accordance with the Conditions of Service herein.

Products exceeding the recommended retail sale price set out by Stark Jewelers shall not be shipped. It is important that you shall not send us any product exceeding this value, unless otherwise expressly authorized by Stark Jewelers. We decline any and all responsibility for any damage, destruction, loss or theft should you ship any such products in violation of the above.

If Stark Jewelers does not provide you with courtesy shipping:

Once your packaging is ready, please contact the carrier of your choice for shipping to the designated address. Stark Jewelers declines any and all responsibility for any damage, destruction, loss or theft of your product during transport, and any of which, should it occur, shall be under your own responsibility.

If you send us your product by your own means with the carrier of your choice, or without using our pre-paid label, you are responsible for the shipping expenses for sending the product to Stark Jewelers, as well as any insurance expenses, and Stark  Jewelers will not be held liable in case of loss, damage, theft or any other deterioration of your product during transportation to Stark Jewelers.

You must keep a proof of shipment. Only products received by Stark Jewelers will be eligible for the Service, in accordance with these Conditions of Service. 

Delivery; Delay

Stark Jewelers will only send and/or deliver your product after receipt of your payment in full.

Please note that we only delivers the United States of America, excluding certain addresses (e.g., military, certain restricted areas (such as hotels), post office boxes, or certain remote areas). We insure parcels while in transit until they are delivered to you. Delivery times are tentative only. When receiving the product, you may be required to send a text message or e-mail confirming that you have received the product.

We will require from you the confirmation of the product’s receipt according to modalities to be set out by Stark Jewelers, at which point the responsibility for the product will be transferred to you. The signature on the receipt will constitute the confirmation of the due receipt of the product in good delivery state.

The delivery will be done at the delivery address registered and confirmed to us as per the terms herein and the delivery will occur according to our guidelines. Attention: if you are not available for the delivery, please follow our instructions, in particular if a third person will be receiving the shipped back product. Please note, we reserve the right to accept or refuse another person to receive your product.

Any delivery date communicated to you is only an estimate, and is not binding on us. Stark Jewelers shall not be liable for any damage resulting from any modification to the delivery date estimate. The transport partner will inform you as soon as possible of any modification to the delivery date estimate. 

Our Cancellation of the Service Order

Notwithstanding anything to the contrary provided for herein, Stark Jewelers reserves the right to refuse, cancel and terminate orders at any moment in time for legitimate grounds. For example, we may refuse, terminate or cancel your Service Order if there is an on-going dispute concerning payment of a prior order or if we suspects that you have violated these Conditions of Service or any laws, or if the law permits so, or in case of counterfeited products, or in case of reasons beyond our reasonable control, including force majeure.

In the event that we cancels a Service Order, any and all indemnifications are excluded and you shall not have any claims against Stark Jewelers, its agents, affiliates and employees.

 

Limitation of Liability

While Stark Jewelers endeavours to verify the accuracy of any information it provides on the Platforms, in advertisements or catalogues, or through the other Service Channels, it makes no guarantees, whether express or implied, in relation to the accuracy, reliability and completeness of such information.

We do not confirm the cost of the Services until a Cost Estimate has been issued by Stark Jewelers.

While every effort will be made to ensure that the descriptions, photographs or graphical representations relating to the Services detailed on the Platforms are as accurate as possible, we does not warrant that such materials or other content are error-free, whether as a result of inaccuracy, omission, obsolescence or otherwise.

To the fullest extent permitted by applicable law, we disclaim and exclude all other terms, conditions and warranties in relation to the Services and Service Channels, whether express or implied by statute or otherwise or arising from any previous course of dealing or usage or trade practice.

Nothing in these Conditions of Service limits or excludes our liability for any liability which cannot be limited or excluded by applicable law. Subject to the preceding sentence, our aggregate liability to you under these Conditions of Service for any order, whether in contract, tort (including negligence) or otherwise, even if we have been advised of the possibility of such damages, shall in no event exceed one hundred percent (100%) of the cost of the Service in your Service Order. Any indirect, consequential, moral and/or punitive damages are in any event excluded.

In the event that you sent us your product in violation of the present Conditions of Service or our instructions, you shall bear any and all risks and costs associated therewith, to the exclusion of any Stark Jewelers liability. In such event, Stark Jewelers shall not be held liable for any risks and or damages, destruction, theft or loss of the product, including during the transportation of the product to Stark Jewelers.

Please note that, in some jurisdictions, consumer protection laws do not allow certain exclusions or limitation of warranties or liabilities, and consequently some of the above exclusions and limitations do not apply.

 

General Provisions

If any provision, or part of a provision, of these Conditions of Service is deemed to be illegal, invalid or unenforceable, the remainder of the provisions of these Conditions of Service shall be unaffected and shall continue to be fully valid, binding and enforceable.

These Conditions of Service (and associated terms incorporated by reference) constitute the entire agreement between you and us in relation to the order of Services, and replace and extinguish all prior agreements, draft agreements, arrangements, undertakings, or collateral contracts of any nature made by the parties, whether oral or written, in relation to such subject matter.

We are not responsible for any failure or delay in performing or complying with our obligations under these Conditions of Service which arises from any cause beyond our reasonable control.

You represent and guarantee that the information you provide in the Service Order is true, accurate and complete at all times; in the contrary case, you will be solely liable of any consequences deriving therefrom.

The waiver by us of a breach of any provision of these Conditions of Service will not operate to be interpreted as a waiver of any other or subsequent breach.

This contract is between us and you. No other person shall have any rights to enforce any of its terms.
